are there any rank or time in service requirements for this position? Also, would this position require the magistrate to not be part of a house/clan?
No rank or time requirements, although given two equally good candidates, I would probably chose the higher rank - simply as evidence of prolonged activity within the DB. Don't let that prevent you from applying tho!
And no, magistrates can remain part of a house/clan.

At my time, a Magistrate needed to be JH at least, but I appointed a GRD anyway. It all depends on the job you can do, I don't think anyone will be anal about rank.
And no, you don't need to leave your Clan or any other positions. It is usually wanted that you are in a Clan even.
And shouldn't you be promoted by now anyway? :)
